TIME FRAME

Foreclosure is not where you should direct your attention to. Foreclosure places you in the position of not being able to purchase a home back by Fannie Mae for a period of 5 years. A sucessful Short Sale will let a home buyer purchase again in 2 years.

CREDIT HISTORY

Foreclosure will remain as a public record on a person’s credit history fo 10 years or more. For a Short Sale the credit history is not reported on a credit report. In most cases a loan is typically reported paid in full, settled or paid as negotiated.

SECURITY CLEARANCE

In almost all cases for government or military security clearance , when a foreclosure is on your record, the clearance may be revoked.  A short sale does not challenge most security clearances.

CURRENT EMPLOYMENT

Employers have the right to regularly check the credit of all employees in a sensitive position and will see foreclosure on their employees records. Short Sale does not affect current employment as it is not reported on a credit report.

DEFICENCY JUDGEMENT

Florida is a deficiency judgement state. In Florida, the bank has the right to pursue a deficiency judgement. If your home sold as an REO foreclosure or at auction, the sale price is usually lower than a short sale price resulting in a higher possible deficiency judgement.  In some sucessful short sales, it is possible to convience the lender to give up the right to pursuit a deficiency judgement against a homeowner.
