			<content:encoded><![CDATA[<p>According to Jackie Bueno Sousa&#8217;s <a href="http://www.miamiherald.com/columnists/jackie-bueno-sousa/story/1148898.html">column</a> in this morning&#8217;s Miami Herald,  the County is not reporting the sold prices of foreclosures.  Instead the property information website is showing the previous sale price and date.  I was shocked by this and didn&#8217;t think that a government website could possibly be carrying purposely bad information.  But it is the truth.  Here are some of my recent foreclosure sales and closing dates and what the County website says:</p>

			<content:encoded><![CDATA[<p>When a homeowner in an association or a condo owner stops paying monthly maintenance fees, the budget falls short and the remaining owners have to pick up the slack.  When there are many owners who, due to foreclosure, have stopped paying their fees, the association has to ask the remaining owners to pay big special assessments to make up the difference.  This is a problem for property owners.  If there are too many non-payers, lenders are less likely to approve loans for prospective new owners.  So people can&#8217;t sell and the situation just gets worse.  I learned about a resource that can help.  Association Financial Services is a new company that guarantees the cash flow of an association and also provides billing and accounting services.  They will guarantee a monthly cash flow based on association fees in return for the eventual late fees and interest plus a service charge.   Here&#8217;s a <a href="http://southflorida.bizjournals.com/southflorida/stories/2008/03/17/story10.html" title="Association Financial Services">story</a> that appeared in South Florida Business Journal.  Here&#8217;s their <a href="http://associationfinancialservices.com/" title="Association Financial Services">website</a>.</p>
<p>Just for the record, I have no financial interest in this company.  I learned about it from Alex Moskovitz, the CFO, while we were both sweating away at the gym.  You can reach Alex at 305-677-0022, ext. 803.  Funny the stuff you can learn at the gym.  Anyway, I thought that this sounded like a good service that people ought to know about and that could help property owners and associations.</p>

			<content:encoded><![CDATA[<p><img border="0" vspace="4" align="left" width="220" src="http://blog.ewm.com/wp-content/blogs.dir/230/files/2008/06/caution-sign.jpg" hspace="4" alt="caution-sign.jpg" />I’ve been working with an investor who buys small apartment buildings downtown near the civic center.  We identified one that he wanted, took a look at it and noted that it had a coin-operated laundry—one washer and one dryer on the premises.  My buyer says to be sure that the coin-operated laundry equipment comes with the building and that there is no lease.  So I put that in the contract, talk to the listing agent and am assured that the equipment comes with the building and that there is no lease.  We negotiate and arrive at a price.  The building passes inspection and a closing date is set.</p>
<p>Next thing a few weeks later, we’re all sitting around the closing table and the seller notices that the contract says that the coin-operated laundry equipment is included in the sale.  She says I don’t own that equipment so I can’t sell it to you.  Uh oh.  Pens stop scratching.  A silence settles.  But you signed the contract that says on the front page about what’s included, right?  Yes, but I didn’t notice that.  And is there any lease?  Well, I didn’t sign any lease, but there’s a guy who gives me a few dollars every other month or so.  Double uh oh.  More silence.</p>
<p>After a lot of discussion, we agree to postpone the closing until a determination can be made regarding lease or no lease.   My buyer doesn’t care about the laundry equipment; he doesn’t want to buy a building that is encumbered by a lease.</p>
<p>Turns out that the laundry equipment belongs to a guy named Pepe and after a few days he comes up with a lease signed by the previous owner of the building.  The lease perpetually renews.  There is no out.  And the lease runs with whoever owns the building.    Forever.  Unless you pay Pepe off and get a release from the lease.  Pepe and his really aggressive lawyer have done this before and have prevailed in court as well.  In Florida, these kinds of leases are legal.</p>
<p>Well, there’s a lot of angst by this point.  Seller wants to sell.  Buyer wants to buy.  Pepe and the sharky lawyer want many many thousands of dollars to go away and threaten a bazillion dollar lawsuit if anybody touches Pepe’s rusty old machines.</p>
<p>Contract deadline is extended and finally seller and Pepe reach a buyout agreement after my buyer agrees to help bear the cost.</p>
<p>We regroup and manage to close.  The title company says that have now changed their check-list to include determining whether or not there are any laundry leases on property.</p>
<p>You should too.   It could be a deal-breaker.</p>

Why is this important?  Because multiple offers mean that buyers, finally, are beginning to believe that prices represent true value.</p>
<p>I did some analysis using single-family homes in Miami-Dade County.  As of this morning there were 1585 homes in &#8220;pending&#8221; or &#8220;backup&#8221; status.  Of those, 1482 were in &#8220;pending&#8221; status, meaning that there was one contract and 103 were in &#8220;backup&#8221; status, meaning that there was one contract and one or more other contracts offered in the hope that the first contract failed for some reason.   County-wide, almost 7% of all contracted homes are in &#8220;backup&#8221; status.   I believe that this is more than has been seen in a long time.</p>
<p>Which areas are the hottest?  I broke the data down for the different parts of town to determine which areas had the highest percentage of backup offers.  I figured that this indicates where the most buyers were finding the best values.  Here are the results:</p>

<p>You can see that the northern part of the county is where the &#8220;backup activity index&#8221; is highest.</p>
<p>If you&#8217;re a seller, one strategy would be to drop your price significantly and hope to start a bidding war.  I was speaking with another agent day before yesterday and he said that he had a property with many offers.  It was a foreclosure that the bank, in its eagerness to sell, had priced too low.  So the price was being bid up!</p>
<p>If you&#8217;re a buyer now may well be the time to plunge in.   Remember, we&#8217;ll never know where the bottom was until we&#8217;re way past it.</p>

The latest leg of her journey takes her not across the country, but across the street.  One of our neighbors who recently lost her beloved cat of 17 years has taken Riggs in.  High Pines, between South Miami and Coral Gables, is that kind of pet-friendly neighborhood. Since the neighbor is French, she&#8217;ll be teaching Riggs a new language.  But I&#8217;m sure that Riggs will be up to it.</p>

Three of our old offices, South Miami, Downtown South Miami and Coral Gables were consolidated in the new digs.  We&#8217;re getting used to all the new faces while we figure out how to make the equipment work and settle in.   The new office is a three-story structure with parking underneath.  EWM is using the entire second floor and we&#8217;re renting out the top floor.</p>
