<div style="margin: 0in 0in 0pt"><span style="font-size: x-small;font-family: Verdana">Miami Beach Commissioner <a href="http://web.miamibeachfl.gov/elected/commission/group1/default.aspx">Jerry Libbin</a> is holding a town hall meeting on October 15, 2008 to discuss reforms needed to protect Florida&#8217;s homeowners from banks that are not paying their fair share of assessments on foreclosed units.  This meeting could have important ramifications for community associations and those that live there.</span></div>

<div style="margin: 0in 0in 12pt;text-align: justify"><span style="font-size: x-small;font-family: Verdana">Becker &amp; Poliakoff conducted an online statewide Mortgage Foreclosure Survey from March 26 to April 8, 2008 which showed a direct correlation between rising mortgage foreclosures and corresponding decline in revenues from maintenance fees and other assessments in the state&#8217;s condominium and homeowner (HOA) communities.More than 60% of the nearly 500 survey respondents said that banks and mortgage lenders now holding title to the foreclosed units or homes are not meeting their legal obligation to pay regular fees or other assessments to the association. Fully 66% of respondents said their association&#8217;s Board of Directors intends to increase maintenance fees and/or pass special assessments to compensate for anticipated shortfall in revenues due to declining maintenance fee and assessment collections resulting from mortgage foreclosures.</p>
<p></span></div>
<div style="margin: 12pt 0in 0.25in;text-align: justify"><span style="font-size: x-small;font-family: Verdana">We believe that these problems are even worse today.  In order to deal with this crisis, we believe that state legislation is necessary.  Section 718.116, Florida Statutes currently states <span style="color: #000000">that the liability of a first mortgagee who acquires title to a unit by foreclosure for unpaid assessments shall be the <span style="color: #cc0000">lesser </span>of the unit&#8217;s unpaid common expenses and regular periodic assessments which accrued or came due during the six months immediately preceding the acquisition of title or one percent of the original mortgage debt.  This limit is commonly referred to as the &#8220;Statutory Cap&#8221;.  There are similar statutory caps in the Cooperative Act and the Homeowners&#8217; Association Act. </span></span></div>
<div style="margin: 6pt 0in 12pt;text-align: justify"><span style="font-size: x-small;font-family: Verdana">The Statutory Cap is having a negative impact on associations&#8217; financial stability and it is being  exacerbated by the excessively slow pace by which the foreclosure lawsuits filed by the first mortgagees are proceeding to judgment and foreclosure sale. </span></div>
<div style="margin: 0in 0in 6pt;text-align: justify"><span style="font-size: x-small;font-family: Verdana">We believe that changes should be made to deal with the inequities present in the Statutory Cap by providing the foreclosing first mortgagee with no liability for delinquent assessments accrued during the six months immediately preceding acquisition of title, but will provide for joint and several liability for all other delinquent assessments for foreclosing first mortgagees.  This would protect banks that act quickly and increase the ultimate cost to those who do not.If you are interested in this issue and/or wish for your association to execute a resolution supporting this proposed state legislation please do not hesitate to contact me or come to the townhall meeting on October 15th.</p>

			<content:encoded><![CDATA[<p>Last week I kept saying that the high tide is too high!!   Here is the explanation for those of you who had a driveway under water from the city. Read on&#8230;</p>

<p>&#8220;As most people have noticed, the City is currently experiencing what is essentially a storm surge, similar to that which we would see during a hurricane, but not nearly as large or dramatic. This phenomena is caused by the City being between a high pressure zone to the West and Tropical Storm Kyle to the East. These two weather systems have caused normal high tides to be 6&#8243; to 18&#8243; higher than normal and is the reason we have so much street flooding. For example, the Collins Canal is being over topped at this time and our previous highest tidal elevations have not cased that to occur. Also, the high water elevation is not subsiding as with normal tidal events because the storm surge effect is a continuing condition related to the weather systems and added to the tidal conditions. The flooding is a direct result of the City&#8217;s elevation relative to the ocean, rather than the capability of the storm water system to properly drain. Our storm water injection systems are working properly where we have them, however, they are overwhelmed by the constant in-flow from the ocean. There is simply too high of a water elevation in the ocean and our system is being back charged.</p>
<p>Pumping or sand bagging is not a temporary solution due the number of ocean outfalls that are affected and the fact that there is no where to put any water that is pumped.&#8221;</p>

			<content:encoded><![CDATA[<p>With the level of concern in both the financial and real estate markets changing by the day, it is sometimes useful to take a longer look at what has been happening in a particular micro market.  For me, that is the South of Fifth neighborhood of Miami Beach, five precious streets extending from the Ocean to the Bay.</p>
<p>I am looking at the absorption rates of some of the big developments in the South of Fifth neighborhood and seeing how various buildings absorption rates differ from the Miami Beach average.  Currently Miami Beach has 3713 condo units on the market, and has averaged 121.5 sales per month for the past 6 months.  A this rate it would take 31 months for all the units on the beach to sell.  How do some of the South of Fifth buildings compare?</p>
<p>The three buildings with the lowest absorption rates are the Courts at South Beach, Icon and the Yacht Club at Portofino, all averaging around 11 months, about a third the Citywide average.</p>
<p>The next group of buildings are the Continuum and Murano Grande, with absorption rates of 15 and 18 months respectively, about half the Citywide average.</p>
<p>The final group of buildings are the Murano, with a 29 month absorption rate, about average for the City as a whole, and Continuum II with a 56 month absorption rate, almost twice the City average.</p>
